Property Registrations to be Linked to Occupancy Certificates by GHMC

Property Registrations to be Linked to Occupancy Certificates by GHMC

In order to combat illegal structures and deviation of buildings from approved building plans Greater Hyderabad Municipal Corporation (GHMC) has mooted a proposal to link registration of properties to the occupancy certificate (OC) and approved plans for curbing illegal structures.

The GHMC has proposed that the registration and stamps (R&S) department should insist on the occupancy certificate (OC) for buildings and approved building plan in the approved layout while registering built up area at under construction buildings on the lines of Tamil Nadu. Chief minister N Kiran Kumar Reddy on Monday approved the proposal put forth by the municipal corporation and asked the revenue department to make the necessary amendments.

As per the new building rules (GO 168), according to officials, the occupancy certificate has been made compulsory for structures irrespective of its size and plot area. The OC is issued by the municipal authority only if a building is built as per the sanctioned plan on plots over 100 square metres. It is also mandatory for getting water, sewerage and electricity connections. "If the registration department makes registrations for the permitted built-up area of buildings as per the sanctioned plan, most of the unauthorized constructions will be controlled. For this, the Registration Act needs to be amended by incorporating an appropriate clause in section 21," GHMC commissioner MT Krishna Babu said. Though the GHMC has been giving nearly 7,000 to 8,000 building permissions a year, only 600 to 700 building owners/ builders came forward to take occupancy certificate.

The GHMC officials admit that deviations in major buildings that come up in a plot size of between 200 sq metres and 500 sq metres could be controlled with the mortgage rule, but they were not able to control structures which come up on plots below 200 sq metres, where the builders take G+1 permission and raise additional floors.

"Apart from these measures, a town planning tribunal is also being considered by the municipal administration and urban development (MA&UD) department to deal with cases pertaining to municipal town planning," the officials said.

Foot Over Bridges for Pedestrians, not for ads! - Lokayukta

Foot Over Bridges for Pedestrians, not for ads! - Lokayukta

The Lokayukta of Andhra Pradesh directed the Commissioner of Greater Hyderabad Municipal Corporation (GHMC) and Additional Commissioner of Police (Traffic) to remove advertisement boards on foot over bridges (FOBs), asserting that they were causing insecurity among women.

The directions by Lokayukta Justice B. Subhashan Reddy were issued while dealing with a complaint filed by one Kanthimathi, president of Right to Walk Foundation, on Saturday.

The two officers were also told to file compliance report by August 22.

In her complaint lodged with the Lokayukta, in which she furnished photographs of several FOBs covered with advertisement boards, Ms. Kanthimathi explained that the advertisement boards put up on the sides of FOBs blocked the view completely, compromising the safety of the users, particularly women, when passing through alone in the absence of proper lighting.

The Lokayukta observed that photographs submitted by the petitioner had made it clear that even FOBs were not spared by the GHMC for business purposes.

The advertisement boards were defeating the very purpose of setting up FOBs for the safety of pedestrians as they were blocking the view completely.

The petitioner also complained that works which were promised to be completed for restoration of footpaths were not done by GHMC. In the reports filed by GHMC Commissioner, it was stated that all works were being attended to and some of them were completed and some others were in progress. The Traffic ACP also filed a report.

Footpaths disappear

In his observation, the Lokayukta said footpaths used to provide safety to pedestrians but over a period of time most of them in Hyderabad had disappeared due to encroachments or road-widening. The road-widening did not mean that footpaths were covered under it. If necessary, the government should make property acquisitions for maintaining proper footpaths, he felt.

The FOBs were constructed in order to alleviate the grievances of pedestrians while using and crossing roads. However, advertisement boards were making them unsafe too, the Lokayukta said. He also directed the GHMC officials to provide proper lighting in FOBs during night.

Early GHMC Property Tax Payers do not get the Rebate

Early GHMC Property Tax Payers do not get the Rebate

Home owners who paid their tax early are disappointed with the GHMC for its failure to live up to its promise. The Greater Hyderabad Municipal Corporation had announced that five per cent discount would be offered on property tax for owners who paid their tax by April-end.

With just four days to go for the first month of the current financial year to end, the tempting sop is yet to be implemented. Over 90,000 tax payers have till now paid `22 crore, but nobody has got the 5% rebate.

“The tall promises of five per cent discount on tax paid before April-end has remained on paper. The GHMC should stop taking the early tax-payers for a ride,” said Amritha Rao, a Somajiguda resident.

As per the GHMC Act, property tax can be paid either in full or in two installments  There are no penalties on the first installment before July 31. After that a penalty of two per cent of the tax is levied on first installment  The last date of submission of  the second installment without penalty is October 15.

After October 15, the penalty is levied on the total tax paid. Citizens who have been paying tax well before July 31, said the government has been waiving penalty on tax in March for the last couple of financial years.

“When those paying tax late are extended the benefit of escaping penalty, why should punctual tax payers like us not be extended the announced benefit? We can keep the money in the bank and earn interest” said A. Dayanand of Tata Chary Colony. GHMC officials said the government is yet to issue the order to implement the scheme.

Sky Lounge Project by Meenakshi Constructions in Hitec City is illegal - Govt.

Sky Lounge Project by Meenakshi Constructions in Hitec City is illegal - Govt.

A private residential complex standing tall in Madhapur has been built on government land flouting all norms and will be taken over by the government in the next few days, senior officials of the revenue department said.

The much-advertised "Sky Lounge " has drawn hundreds of potential buyers looking for plush apartments in three specially designed 18-storeyed towers spread over 9 acres of prime land.

But authorities said that survey numbers 50 and 51 of Khanamet village in Madhapur, where the towers have come up, belong to the government and the construction firm has not been able to furnish any document to prove its ownership, the officials said.

On Friday, government staff went and put up a board cautioning that the construction was illegal and the towers have been built up on government land. "We have been investigating this matter since the past four months and it is now proved that the construction took place on government land," said B Rajesham, deputy collector and tehsildar, Serilingampally mandal, Rangareddy district.

Located very close to the Hi-tec City, the Rs 500 crore-valued "Sky Lounge" consists of 432 flats, of which 10% are occupied and more than 50% have been sold off for undisclosed amounts. Each flat was sold for at least Rs 4,500 per square feet and some for more, an official said.

With an array of luxury features, including a clubhouse, swimming pool and landscaped garden, politicians, actors and even senior government officials, are learnt to have booked apartments in these towers.

Authorities said the construction firm, Meenakshi Constructions, failed to prove its ownership of the land. "There have been at least five hearings prior to this order being passed and on all these occasions representatives of Meenakshi Constructions could not prove that it was their land. We have already put up a notice board inside the enclave and we will soon take possession of the property," Rajesham said.

However, he was unsure what would happen to the fate of the occupants, once the government seals the complex.

Private developers taking over government land for constructing flats is not uncommon and government too, whenever it comes across such cases, has demolished illegal structures.

''GHMC officials colluded with builders''

But in most cases, developers, after long-drawn legal wrangles, have won courtroom battles, and have managed to use their influence to get them regularised.

An RTI activist, who was responsible for blowing the lid, called for action against erring officials who had given necessary permission for the construction. "The construction of these buildings started in 2006, but I got to know in 2010 from locals that this project could be illegal." said Challa Shobhan, an activist from Serilingampally. "For the next three years I procured various documents from municipal and revenue departments, which proved that this land belonged to the government and not Meenakshi Constructions. I immediately lodged a complaint with the revenue officials a few months back," he said.

"The GHMC officials have colluded with builders and this is the reason why they gave permission for these high-rise residential structures".

When contacted, K S Rao, chairman of the Meenakshi group said they were in possession of the "original land documents which proves they are the owners".

GHMC: Financial assistance for building Rain Water Harvesting Structures

GHMC to go after 5 Lac Property Tax Defaulters

GHMC to go after 5 Lac Property Tax Defaulters

After collecting a record property tax collection of more than Rs.750 crore in the last financial year 2012-2013 ending 31 Mar 2013, the GHMC has announced its intent to go after the chronic defaulters of about five lakh property owners. At the same time, the top brass also promised to ‘incentivise’ early tax payers.

A rebate of five per cent property tax was to be given to citizens paying the entire year amount before April 30 as per the proposed changes to the GHMC Act by the Municipal Administration & Urban Development Department.

Officials clueless about Five Percent Rebate to Early Property Tax Payers

But, with less than 10 days left for the month to end, municipal officials have no clue about the status of the incentive or even whether the changes to the Act have been made or not.

Earlier, it was announced that the amendments to the Act would be passed during the ongoing budget session of the Legislative Assembly.

Citizens ask for Clarity

However, the officials are not willing go on record and want to wait till Commissioner M.T. Krishna Babu returns from his China trip. In the meantime, citizens have been calling up newspaper offices enquiring about the tax incentive.

“We read about the five per cent rebate for early tax payers. Is it on?” wondered Herman Papali.

A time limit of 90 days from the commencement of half year for payment of property tax without levying a simple interest and 100 per cent tax penalty on unauthorised constructions are also among the proposed changes.
